These Terms and Conditions constitute a contract between Roam Wales and the Customer. Roam Wales and the Customer accept and agree to be legally bound by these Terms and Conditions. A full or part payment and acceptance of such by Roam Wales to use the Services of Roam Wales signifies an understanding and acceptance of these.
1. Interpretation
1.1 In these Conditions:
“Conditions” means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Customer and Roam Wales;
“Contract” means the contract between the Customer and Roam Wales for the supply of Goods and/or Services in accordance with these Conditions;
“Customer” means the person whose order for Goods and/or Services is accepted by Roam Wales;
“Goods” means the goods which Roam Wales sells to the Customer under these Conditions;
“Order Confirmation” means the acknowledgement of the Quotation provided by Roam Wales to the Customer whether written or oral;
“Quotation” means the quotation for the Goods and Services provided to the Customer by Roam Wales whether written or oral;
“Services” means any services provided to the Customer (including all of them or any part of them) under a Contract; and
“Roam Wales” means the Roam Wales business selling the Goods and/or Services, details of which are given in the Quotation and/or whose details have been provided to the Customer either in writing or orally.
1.2 Any reference in these Conditions to any provision of a statute shall be construed as a reference to that provision as amended re-enacted or extended at the relevant time.
1.3 The headings in these Conditions are for convenience only and shall not affect their interpretation.
2. Reservations and Payment
2.1 Reservations can be made through the Roam Wales website or directly with the tour booking team on +44 (0)2921 510108.
2.2 Payment in full must be made at the time of booking. Upon receipt of full payment, reservations will be confirmed by Roam Wales either by phone or e-mail along with an order number, which will constitute confirmation of reservation.
3. Cancellation
3.1 In the event of the Customer needing to cancel a tour booking, Roam Wales applies the following cancellation policy:
Day Tours – Roam Wales require a minimum notice period of 72 (seventy-two) hours before the tour departure time of 09.45.
Private Tours – Roam Wales require a minimum notice period of 21 (twenty-one) days before the date of the tour.
If the Customer provides sufficient notice (as outlined above), Roam Wales will make a charge of 10% of the total booking price as an admin fee to cover time and costs. Roam Wales will refund the Customer the remaining balance. If the Customer does not provide Roam Wales with sufficient notice, the booking will not be refunded.
3.2 All cancellations by the Customer must be made in writing by the customer to the Roam Wales.
3.3 Refunds will be made by the original method of payment within 10 days of receipt of cancellation notice.
3.4 Roam Wales will endeavour to provide the tour itinerary as planned but reserve the right to cancel for whatever reason any planned tour.
3.5 All tours are subject to a minimum number of passengers. If an alternative cannot be offered or taken, Roam Wales will refund in full total tour cost within 10 working days.
3.6 No compensation, consequential losses or other such claims shall be entertained in the event of such cancellation.
4. Prices
4.1 Prices quoted shall be current at the time of booking, acceptance and acknowledgement. The price agreed shall not be subject to any change unless forced due to circumstances beyond our control.
4.2 The price paid to Roam Wales shall include sightseeing as indicated on the itinerary, transportation, vehicle, qualified driver guide and statutory insurance.
4.3 The price paid to Roam Wales shall exclude personal insurance, refreshments, entrance fees, and excursions, gratuities and any other item not specifically mentioned as being included.
5. Tour Itinerary
5.1 Whilst Roam Wales will endeavour to provide the tour as set out in its description Roam Wales reserve the right to cancel, alter or change transport type for whatever reason.
5.2 Where Roam Wales cancels a tour, the limit of liability will be limited to the return of all monies paid.
6. Attractions and Stops
6.1 Attractions, highlights and stops visited during any tour may have specific reservation rules, payment procedures and health and safety rules which passengers must all times observe. As with any product or service the passenger is entirely responsible for their own safety whilst off the vehicle. Going off unmarked pathways, through closed gates or barriers etc is done entirely at your own risk and no responsibility can or will be taken by Roam Wales in such event.
7. Seating
7.1 Unless specified seating will be on a ‘first come, first served’ basis. In order for passengers to share equally the enjoyment and sights of the tour seating positions may be rotated at the request of the driver.
8. Children
8.1 Children under the age of 16 (sixteen) are not be permitted to use the services of Roam Wales unless accompanied by an adult at all times. Full responsibility shall remain with the accompanying adult for the conduct of such child/children at all times thus ensuring the safety and respect of all on board.
9. Animals and Pets
9.1 With the exception of registered and documented assistance dogs, animals are not permitted on board Roam Wales tour vehicles.
10. Passenger Comfort
10.1 To comply with legislation and for the safety and comfort of our passengers the use of alcohol, tobacco and non-prescribed drug products is strictly prohibited on tour vehicles at all times.
11. Luggage
11.1 Luggage space is limited and therefore passengers are restricted to one small bag e.g. handbag. or backpack, for personal carry on items. Roam Wales will not accept liability for loss, damage, theft or general handling or otherwise of any luggage.
12. Late Arrival
12.1 Roam Wales operate a strict time-keeping policy for all tour departures and will allow only 10 (ten) minutes after the scheduled departure time to elapse prior to departing. In the event of missing a departure, the booking will be deemed as cancelled in accordance with our cancellation policy and the full booking price will be forfeited. No compensation, consequential losses, additional travelling costs, or other such claims will be accepted in such an unfortunate event occurring.
12.2 During any tour, it is the responsibility of the passenger to return to the vehicle/group on time, as set out by the driver at each stopping point. Whilst every effort will be made to locate late person(s) a period of 10 (ten) minutes will be allowed to lapse before departure and continuation of the tour. In the event of passenger missing departure and the remainder of the trip, the tour will be deemed as cancelled in accordance with our cancellation policy.
12.3 It shall be the traveller’s responsibility to return to the tour collection point or secure transport to meet up with scheduled tour on route. No claims for compensation, additional travelling costs or other such claim will be accepted.
13. Insurance
13.1 Roam Wales operates within all United Kingdom laws that include compulsory and statutory insurance against accident and third party liability. Insurance against personal injury, theft and other loss is not included and it is therefore recommended that the customer arrange their own suitable travel insurance.
14. Departure and Return Points
14.1 Roam Wales tours depart from a single central location in Cardiff City Centre. Upon securing your reservation, you have the choice of joining Roam Wales at any of the convenient locations specified when booking. If you need to take a transfer to get to any of the locations, costs, fees, and/or parking charges may apply which will be the responsibility of the traveller. Return point will be the same as the tour departure point.
15. Weather, Traffic and Road Conditions
15.1 Roam Wales will not accept responsibility for last minute alterations or cancellations due to weather conditions. (An alternative tour date will be offered or cancellation in accordance with the cancellation clause by Roam Wales as set out above). Roam Wales will not accept responsibility for delays or otherwise due to traffic and/or road conditions or other related circumstances beyond our control. In the event of such occurrence, no compensation, consequential losses or other such claim will be entertained.
16. Vehicle Breakdown or Immobilisation
16.1 Roam Wales will not accept responsibility for last minute cancellation, delays or any other related circumstances due to vehicle breakdown or immobilisation. In the event of such occurrence, no compensation, consequential loss or other such claim will be accepted. Should such occurrence take place after departure Roam Wales will be responsible for returning passengers to point of inception of their journey with Roam Wales.
17. Enjoyment Of Tour
17.1 Roam Wales shall not accept responsibility for your overall enjoyment. Whilst all effort is made to maximise your experience with Roam Wales, it is universally accepted that each person’s preferences and tastes are unique and therefore an impossible task to satisfy all our customers all of the time. Roam Wales accept that its own success is dependent on word of mouth recommendations and customer satisfaction.
18. Reserved Rights
18.1 Roam Wales reserve the right to make operational changes at any time be it to the route, itinerary or otherwise, with or without notice.
18.2 Roam Wales reserve the right to cancel a booking at any time, should conditions or circumstances necessitate, offering substitutes of equal value or as full refund without administration charges or penalty as set out in our cancellation policy by Roam Wales. If circumstances warrant such action a full and documented reason shall be provided.
18.3 Roam Wales reserve the right to decline, accept, eject or retain any person as a member of the passengers at the discretion of the driver. No claim for compensation, consequential losses, additional travelling costs or other such claim will be accepted.
18.4 Reasons for such actions shall include, but not be limited to:
- Failure to comply with the laws of the United Kingdom.
- Violent, racist, verbal abuse or other unacceptable behaviour.
- Refusal to comply with Health and Safety issues.
- Refusal or failure to pay the fee requested for said tour.
- Any other form of behaviour deemed to be disruptive, dangerous or insulting to other passengers.
19. Force Majeure
19.1 Roam Wales cannot and will not accept any liability or pay compensation where the performance of Roam Wales is prevented from carrying out any contractual obligations due to but not limited to war, threat of war, riot or civil commotion, terrorist attack, crime, industrial disputes, explosion, nuclear attack, cyber attack or other events beyond the control of Roam Wales.
